Terms of sale

1. Purpose

These terms of sale apply to all sales of photographic prints offered on axelmassonstudio.com by Axel Masson EI, a French sole proprietorship (SIRET 813 470 788 00015), hereinafter "the seller". Full contact details are given in the legal notice. Placing an order implies unreserved acceptance of these terms, which the customer acknowledges having read before ordering.

2. Products

The products are prints of the photographs shown on the Prints page, in the sizes, papers and finishes described on the website. The colours of the photographs shown on screen are not contractual, as they depend on the screen used.

Custom prints (size, paper or medium made at the customer's request) and framing or mounting are subject to a personalised quote.

3. Prices

Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code. Prices exclude shipping. Shipping costs depend on the size and destination; they are sent to the customer before any payment. For deliveries outside the European Union, any customs duties and import taxes are paid by the customer.

The applicable price is the one shown on the website when the order request is made.

4. Orders

The customer fills their cart and sends their order request using the dedicated form, after accepting these terms. The seller replies by email with a summary: prints ordered, price, shipping costs, production time and, where applicable, a framing quote. The sale is concluded when the customer accepts this summary and payment is received.

The seller reserves the right to refuse an order for a legitimate reason (for example an abnormal request or a previous dispute).

5. Payment

The total price (prints and shipping) is payable in full when ordering, before production, by one of the following means:

Production starts once payment is received.

6. Production and delivery

Prints are printed and, where applicable, framed in France. The production time is stated in the order summary. As a guide, once the order is confirmed and payment received, it is usually:

Delivery usually takes a further 2 to 3 days. Unless otherwise stated, the print is delivered no later than 30 days after the sale is concluded.

The seller delivers worldwide, to the address given by the customer, in packaging designed to protect the prints. Hand delivery can be arranged by appointment.

In the event of late delivery, a consumer may, after asking the seller to deliver within a reasonable additional period, cancel the sale if delivery does not take place within that period (article L216-6 of the French Consumer Code).

The customer is asked to check the parcel on receipt. If the print arrives damaged, the customer must inform the seller within 48 hours, with photos, via the contact form: the print will then be remade or refunded. For consumers, the risk of loss or damage passes to them when they take physical possession of the print.

7. Right of withdrawal

Consumers have 14 days from receipt of the print to withdraw from the sale, without giving any reason (articles L221-18 et seq. of the French Consumer Code).

To do so, the customer informs the seller of their decision by an unequivocal statement, via the contact form or using the withdrawal form below. They then return the print, in its original condition and in protective packaging, no later than 14 days after communicating their decision. Return costs are paid by the customer.

The seller refunds the price of the print and the initial shipping costs (based on the standard delivery method) within 14 days of receiving the withdrawal decision, using the same means of payment as for the order, unless otherwise agreed. The refund may be withheld until the print has been received back. The customer may be held liable for any loss in value of the print resulting from handling other than what is necessary to establish its nature and characteristics (article L221-23 of the French Consumer Code). In that case, the amount deducted from the refund corresponds to the loss in value observed when the return is received, justified to the customer with photographs, and may be up to the price of the print if it can no longer be sold. The print travels at the customer's risk during its return: suitable protective packaging is essential.

Exceptions. In accordance with article L221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the customer's specifications or clearly personalised, that is, custom prints (size, paper or medium made on request) and prints framed or mounted on quote.

The right of withdrawal does not apply to business customers.

8. Legal guarantees

Consumers benefit from the legal guarantee of conformity (articles L217-3 to L217-20 of the French Consumer Code), for two years from delivery, and from the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). To use these guarantees, the customer contacts the seller via the contact form.

9. Intellectual property

Buying a print does not transfer any copyright in the photograph. The print is intended for private use; any reproduction, distribution or commercial use of the image is prohibited without Axel Masson's written permission.

10. Personal data

The information provided when ordering is used only to process the order, as described in the legal notice.

11. Mediation

In the event of a dispute, consumers may use a consumer mediator free of charge, after first trying to resolve the dispute directly with the seller in writing (articles L612-1 et seq. of the French Consumer Code): CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France – www.cm2c.net, where claims can be submitted online.

12. Governing law

These terms are governed by French law. Failing an amicable solution, disputes are brought before the competent courts; consumers may choose the court of the place where they lived when ordering or where the damage occurred. Consumers living outside France also keep the protection of the mandatory rules of their country of residence.
